Success And Personal Success - 746 Words

Success is more than the definition that society has created over the course of the years. Being successful in society is very different than actually being successful in my opinion. Success in my opinion is having the courage, strength and the ability to work hard towards your goals no matter what. Also at the same time being humble and able to appreciate what you have accomplished by not bragging your success to someone who is lesser than you. When I was young, I always wanted to drive a brand new Land Rover and live in a mansion with my husband and kids. I was always going to have the latest and greatest inventions and wear the best clothing brands. I would make sure that my kids had everything that they needed and make sure that I†¦show more content†¦I feel that I will be more successful and it will help me be more well rounded if I was able to study abroad. Ultimately after college I want to be able to provide and take care of my own family. I also want to be someone that my friends, co-workers and anyone around me will be able to count on me no matter what. After I graduate from Endicott and receive my diploma, I will feel that I have taken the right steps in being able to be one of the most successful. I want to be able to tell my kids about all the great times I had at Endicott and how proud I am to have gone to such an amazing school that has contributed to my success in so many ways. This will allow me to look back and appreciate the friends I had made, the experiences I encountered, and the amazing education I received. Endicott will help me succeed professionally in various ways. Since Endicott is just twenty minutes from Boston and the best hospitals in the area there will be a lot of internships that will be available to me. When I walk into these internships on my first day, I will be excited for the work force in the moment and for after my education at Endicott. In the Brownfield case the morning-after pill prevents fertilization or inhibits implantation of the fertilized egg. A rape victim should have the necessary treatment available or get referred to another hospital and in an event that they are not given the proper treatment they should have a viable claim for medical malpractice. I agree with the decision that was made by the judge and here is my reasoning. If the morning after pill is given to a rape victim it stops the attachment of a fetus which was conceived under a vicious crime which would not be considered an abortion since the morning after pill has prevented the attachment. I think that it is a patient’s right to control their own health care and that this should prevail over any hospitals moral and religious convictions, because we as patients need to know what is available and the best treatment out there to insure our well-being. As I stood in front of my best friend while she sang nauseating love songs about Bradley and I, I couldn’t help but feel as though I had betrayed my culture. I stared at the ground feeling ashamed for thinking about boys and love. But I sensed a spark of excitement in the prospect of â€Å"going out with someone.† It was getting late and the burning sun was setting, so I said goodbye to Lisa and went inside for dinner. My mom was sitting at the kitchen counter and I approached her timidly. I felt guilty about my hopscotch declaration and I was going to confess my sins. But it seemed that as I got closer, my courage faltered. A few years later, I tried again. Sitting at the kitchen counter at the age of fourteen, I listened to my mom lay out her hopes for me. The lofty subject of marriage intimidated me. But it continually nudged at me, asking for answers. So I satisfied my curiosity. â€Å"I want to give you the fr eedom to choose who you want to spend your life with,† my mom said. â€Å"You should be free to make your own decisions in choosing a husband.† I listened to her gentle words and I knew that I should have felt liberated, but still something tugged at me. It was a custom that I felt guilty leaving behind. Life was made of sacrifices. I thought that perhaps my parents had sacrificed a bit of themselves for tradition. And I respected them for their strength. Although once I did not understand the meaning of love, I had come to realize that I did not want to make the same sacrifice as my parents. Tradition and culture were important to me, but I didn’t want to give up a part of myself for them. I didn’t want to feel as though I had missed out on a part of life. I wanted to experience all of the magical feelings of Ramona’s world. I had been caught in a clash of two cultures. Of two generations. It was the world with Lisa hopscotching on the sidewalk v ersus the world in which my grandparents and parents had grown up. It was a tough tug-of-war between the two. But I was ready to let the rope fall.

It is interesting to take note of the fact that the tripartite view with regards to the soul is a view held by people even in the ancient times. As a matter of fact, the Greek philosopher Plato had the same view albeit, there are nuances that must be considered in this interpretation. In his book Ten Theories of Human Nature, Stevenson claims that there are certain â€Å"parallelisms† with regards to Plato’s account of the soul to Freud’s theory of the human psyche. Stevenson writes: â€Å"The Id, like Plato’s Appetite, is made up of the instinctual drives that seek immediate satisfaction; the Ego is not exactly parallel to Plato’s Reason, but it does have the function of dealing with the real world and mediating in the relationship of the world and the Id; the Superego contains the conscience and the social models absorbed as a child† (Stevenson 74). On a deeper analysis, we can plausibly contend that Freud’s division of the human psyche into the Id, Ego and the Superego is in itself a division that is highly â€Å"metaphysical† which stands in direct opposition to one that is â€Å"empirical†. However, what is exceptionally brilliant in Freud is the fact that he was able to make his metaphysical assumptions to have a strong hold and to bear an imprint in the minds of the scientists thereby, consequently leading to the idea that his theory of the mind can be understood within the schema of scientific inquiry. The universe is a machine. This metaphor is actually an attempt to explain phenomena by positing different kinds of laws that govern the universe. The universe and the bodies within it are governed by physical and mechanical laws, for instance. A more thought-provoking aspect of this metaphor however, has something to do with the fundamental questions regarding the issues regarding â€Å"determinism† and the concept of â€Å"free will†. The mechanistic model of the universe and the formulations in and through which we appropriate and understand phenomena for ourselves depicts a scenario that everything in the universe is determined including thinking and behavior of human beings. Thinking is in itself a mechanistic procedure which can be explained by the firing of neurons in the brain and by taking into consideration the psychological or mental states that a person has. As Freud sees it, it makes sense to say that a person’s action is for instance, determined and is caused by pre-existing psychological or mental states. The valuable contribution then of Freud is the fact that he was able to integrate his theory of the mind into the schema of science. He also made extensive use of the concept of â€Å"causality†. Causality, as a scientific principle may be defined as â€Å"the operation of cause and effect†. Causes and effects are important categories or markers in scientific inquiry. In psychoanalysis for instance, the primordial assumption is that certain neuroses or abnormal behaviors are caused by â€Å"repressed† psychological or mental states. Freud, to be more particular, traces the causes of these neuroses or abnormal behaviors to â€Å"traumatic experiences† that a particular person has experienced in his or her past life. These things might be concealed from the individual, meaning, the individual does not have the knowledge that he or she has had such traumatic experiences or that he or she has had repressed emotions. The person may also not be aware that of a à ¢â‚¬Å"thought† or a â€Å"desire† that has long been there, that has long been present in his or her psyche. This brings us to Freud’s theory of the â€Å"unconscious†. What is the unconscious? The theory of the unconscious is also a theory patterned from the schema of science and hence, is also characterized as strictly deterministic. When we speak of the mind, we have the tendency to assume that what we are talking about is that which we use when we think of our thoughts. We assume that there are only â€Å"conscious mental states† and â€Å"conscious mental processes† and we identify them with the â€Å"mind†. Freud sees it in a different way. The usual analogy used to explain this is the analogy between the mind and an iceberg. The mind is like an iceberg; it has parts that can be seen and parts that cannot be seen. The mind or the human psyche, for Freud has two parts; the conscious and the unconscious. On a personal note, the strength of Freud’s theory of the mind and the unconscious is the fact that they are deterministic. This puts them at par with the other sciences albeit we must take into consideration that the object of study of the empirical sciences is different from the object of study of the social sciences such as psychology. Freud’s groundwork on psychology and his attempt to integrate it with the methodology of science paved the way for doing psychology scientifically. Succeeding psychologists have benefited enormously from the scientific way of doing psychology nowadays. Persons afflicted with psychological disorders are now assured of a better and more humane treatment. Aside from these, Freud’s theory illuminates some of the dark areas of our being human. One such example is our tendency to bury deep in our minds certain desires, things or dreams that we want to pursue because most of us are afraid to take risks. Freud makes us see that no matte r how much we try to bury these things deep in our minds, they will creep out eventually and will make manifest on us in different ways. There is no escape from these desires. However, the implications of the theory are disturbing. As stated on the earlier part of this essay, the theory, being based on the scientific model, leads to the idea that everything is determined, that everything is governed by the same scientific and mechanistic laws. This idea also breeds another idea; that human actions, the basis of which is capacity for thought, is determined. Human beings are not free as most of us would like to believe. What we call freedom is merely illusory. In the same vein, what we call free will is also an illusion; a figment of the imagination, a mere hope that is divorced from reality. Philosophy, as I see it, is all about setting the limits. It is about â€Å"being in control†. This may be observed even in the ancient Greeks’ treatment of philosophy and rationality. The entity that sets the limits, that which is in control is none other than the faculty of reason. Due to this, it is indeed difficult to accept that what Freud says is true. The mere presence of unconscious mental states and mental processes suggest that there are considerably significant aspects of our lives, behaviors and thoughts that are unknown and hidden to us. The source of the â€Å"uneasiness† as I reckon it is the fact that if the theory is true, then there are things about ourselves and about our actions that are beyond our control.

The spoken language of the south is undeniably unique; however, the unique language is not a language resulting from uneducated and ignorant Americans. The origin of southerners influences the way they respond to different situations throughout their life. Brooks demonstrates his knowledge of different cultures in this essay. My Favorite Entrepreneur Essay My favorite entrepreneur: Ms. Oprah Winfrey Oprah Winfrey was born into poverty by a teenage single mother in 1954 in Kosciusko, Mississippi. For the earliest years of her life she was raised by her maternal grandmother, and under her kind-hearted discipline was taught to read by the age of two and speak exceptionally by the age of three. When Winfrey was six years old, she was sent to live with her mother in Wisconsin. She was submerged into inner-city Milwaukee, and faced the hardships of growing up in the urban ghetto. Her mother had many problems of her own and was so consumed by them that she was unable to give attention to her daughter. This had many adverse consequences, and left Winfrey vulnerable to multiple counts of sexual abuse at an early age, including by her mothers boyfriend, a teenage cousin, and a family friend. She also became pregnant at the age of 14, but her son died at infancy. As she got older, she struggled with racism and was discriminated against by her peers because of her economic status. The neglect and problems she encountered led Winfrey to develop an aggressive attitude, and eventually her mother could no longer deal with Winfreys delinquency and so she sent her to live with her father in Nashville, Tennessee. With his strict disciplinary mechanisms and value for education, Winfreys father helped her turn her life around. She became an honor student and at the age of 17 began her broadcasting career on the radio station WVOL. She earned a scholarship to Tennessee State University and studied drama and speech. At the age of 19 she landed an anchor position for WTVF-TV, Nashvilles CBS affiliate. Here she was the first African-American and the youngest person to ever be an anchor on the network. Not too late afterwards in 1976 she moved to Boston to take on a position as co-anchor for WJZ-TV evening news. However, it was hard for her to contain her emotions on many of her stories, and her attachment to the subject matter made her a poor fit for the position. She was fired for these reasons. Nevertheless, a manager at the network saw her ability to connect closely with the subjects and her excellent communication skills and found a position more suited towards her as a co-host on talk show People Are Talking. The show’s ratings soared, and Winfreys success attracted attention in the Midwest where she was offered a position as anchor on AM Chicago. It almost instantly became the #1 local talk show and within a year was renamed the Oprah Winfrey Show. The show was soon picked up in 120 cities and became the nation’s top talk show. However, Winfrey did not like the idea of working for someone else, and in 1986 she founded Harpo, Inc. and took on the Oprah Winfrey Show by 1988 in her own studio in Chicago. The third woman in history to own and produce her own show, as well as the first African-American to own her own entertainment production company, Winfrey was capitalizing success. The early years of the program was classified as a tabloid talk show, however as years went on Winfrey adopted broader topics such as disease, spirituality, substance abuse, geopolitics, domestic topics, celebrity interviews, and philanthropy. She herself has become one of our worlds most noted philanthropists and also hosts televised giveaways. In addition to her talk show, Winfrey acted and voiced-over in different movies and TV shows, as well as ones she produced herself like The Women of Brewster Place and Brewster Place. Furthermore, Winfrey has co-authored five books and publishes O, The Oprah Magazine and O at Home, which was dubbed the most successful start-up ever in the industry by Fortune in 2002. She also created her website Oprah. com, one of the top womens lifestyles websites, as well as Oprah’s Book Club, the largest book club in the world. Winfrey went on to co-found womens cable television network Oxygen. In January, 2011, Discovery Health Channel was changed into a new channel called OWN: Oprah Winfrey Network. Winfrey, for many years now, has been viewed as the most powerful woman in the entertainment industry, and even beyond the entertainment industry. The Wall Street Journal coined the term Oprahfication meaning therapy through public confession, and there have been numerous incidents of the Oprah effect where her public opinions influence consumer choices. She has been invited onto the corporate boards of ATamp;T, Ralph Lauren, and Intel, all of which she turned down. Winfrey holds a fairly private personal and business life, as all her employees are sworn to keep things private for the remaining of their lives, and she holds full control in all her distribution deals with ABC, Oxygen Network, and Hearst Magazines. She also holds 90% of Harpos stock. By the age of 41, Winfrey had a net worth of $340 million and replaced Bill Cosby as the only African American on the Forbes 400. She has remained the only African American to rank among Americas 400 richest people nearly every year since 1995, and is the ichest African American of the 20th century. From 2004 to 2006 Winfrey was the worlds only black billionaire and the first black woman billionaire in world history. In 2010 she took on the title of the richest self-made woman in America. Her 2011 salary was $290 million and she had a set worth of $2. 7 billion. Throughout this all, Winfrey is lives her life by two principles: live a great life for yourself and make a difference in the world. These ha ve been motivating factors for Winfrey too overcome the different struggles in her life and pull forward to a positive outcome. Her intellectual and emotional qualities paved the way for her to really connect with diverse people of difference backgrounds, values, and experiences, and to open up all sorts of subject matter in a some-how comfortable setting although very public. Her public speaking and proficient communication abilities allowed her to emerge as such a strong candidate in the industry. Even with that, Winfrey is a woman of self-improvement and took improv classes at Chicagos own Second City to work on her presence and wit in high pressure situations like on talk shows and live television. But her success isnt all in her broadcasting or talk shows. In fact, Winfrey says her success began as a third grader when she turned her book report in early. She stands by the ideas to always go the extra mile, and that we are all entitled to success. Let excellence be your brand, Winfrey says at a 2012 speech to Spellman College graduates. Winfrey is a strong believer in doing the right thing, and she guarantees that doing right will only allow for right to come back to you and carry you on your way to success. Another point Winfrey strongly upholds is finding a way to serve. She says that she doesnt serve TV she serves the world through TV, and that is what each of us should do as we find our niches to use our success as a way to serve. Furthermore, Winfrey believes it is key to know who you are and to take charge of your life. Making decisions for one’s self and pursuing goals is absolutely critical if one wants to find success. Winfrey was able to use these ideals, lessons from her life, and her true passions and talents to go from rags to riches, to become the Queen of talk shows, and a historical success legend.

Adolescent Girls at Risk What risks are really in existence for adolescent girls growing up on the Arizona-Mexico border? Well, more then anyone in their right mind might be able to imagine. Adolescent girls growing up on the border or in a multicultural area are generally from lower income homes, which in itself introduces an entire set of risk factors. The main focus, but certainly not the only ones at risk, being that of minority groups, such as Hispanic and American Indian girls. In general, they are at a risk for teen pregnancy, drug and alcohol abuse, gang affiliation, and academic and social challenges at school. Now this might not seem entirely foreign or surprising to some people. In fact, almost all high school students are at risk for everything listed, but the degree to which the girls are vulnerable to these risks in a multicultural environment can be alarming. There are many factors that can affect an adolescent girl’s degree of risk, and these factors are generally characterized as â€Å"stressors.† Stressors can consist of many things, from family problems, to social problems, to problems with academics. In migrant children, the stressors can be from the actual act of moving. They can also develop from difficulties in adjusting to a new area where they are now the minority and are being discriminated against for the first time (Canino & Spurlock, 18). This can cause a marked decline in self-esteem, which leads to even more difficulties including metal health problems. Ralph Waldo Emerson and Frederick Douglas in Relation to Self-Reliance Essay

Ralph Waldo Emerson was born in 1803 in Boston although his family were not wealthy they were well connected, privileged and educated. Emerson attended Harvard, Harvard Divinity School and became a minister interested in such topics as non-conformity, the individual and the soul. Frederick Douglass was born in 1817 in Maryland the son of a slave and white man. He was born into slavery, saw his mother only a few times and did not know his father. Douglass went on to be an abolitionist, an editor of a newspaper, an avid writer and lecturer. These two men couldn’t have been from more diverse worlds. They may as well have been from different planets. While walking the green sunlit quads of Harvard, Emerson was fleshing out his esoteric thoughts on the soul, nonconformity of the individual and the subtleties of self-reliance. In contrast, Douglass was in a dark barn being beaten on his bare flesh by a brutal overseer who held the key to the gate of slavery. This beating took place in August of 1833 while Emerson had already written a few of his ideas in his journal for his essay, Self-reliance by 1832. (Self -Reliance was first published in 1841). Slavery was a subculture set up for the benefits of farmers, plantation owners and rich city folk who could afford to buy people – not hire them but buy them. The slaves were isolated McTeigue 2 physically and mentally from the rest of the community and the world in order to maintain control and keep them within the bounds of the strict unspoken codes of slavery set up by the their owners. The codes signed, sealed and delivered by the overseers or the masters of the slaves. And when that didn’t work they were sold and separated from any family and friends they had. The system of slavery didn’t allow and didn’t encourage the development of the individual person. Man or woman. Instead as Douglass states relating to the slave, â€Å"It is necessary to darken his moral and mental vision, and, as far as possible, to annihilate the power of reason. He must be able to detect no inconsistencies in slavery; he must be made to feel that slavery is right; and he can be brought to that only when he ceases to be a man† (Douglass 1790). Douglass transforms the collective mindset of him the slave to that of an individual, self-reliant man without the ivy clad buildings in which Emerson ruminated, pondered and wrote. For slavery to exist there could be no individual man or woman that had ownership rights over his or her own body or mind; despite this truth Douglass escapes from slavery and clearly steers destiny into his homeport of freedom hitting all the main points of Emerson’s theories on SelfReliance; trusting-self, non-conformity and intuition on the way there. Trusting yourself on the path to Emerson’s, Self-Reliance, and becoming an individual is one of the main tenets of Emerson’s writings. â€Å"A man should learn to detect and watch that gleam of light which flashes across his mind from within, more than the lustre of the firmament of bards and sages† (Emerson 1334). Frederick Douglass’s first â€Å"gleam of light† was in the songs the slaves sang on the way to their masters main house. He describes the songs which were McTeigue 3 sung in deep tones like anguished souls as prayers for deliverance from slavery. Douglass states, â€Å"To those songs I trace my first glimmering of the dehumanizing character of slavery† (Douglass 1754). A seed was planted and took hold in his soul. He continued to listened for clues along the way to trust and believe. A pivotal opportunity to trust himself in a new revelation was offered to Douglass while learning the alphabet and simple words at the home of his new master’s in Baltimore. When the father of the house found out that his wife was teaching the slave boy how to read, she was told that for one thing it was against the law. But the main point of his disapproval was this as told by Douglass, â€Å"if you teach that nigger how to read, there would be no keeping him. It would forever unfit him to be a slave. He would at once become unmanageable, and of no value to his master. As to himself, it could do him no good . . . It would make him discontented and unhappy† (Douglass 1762). Douglass explains that it was in this moment that he understood what the key was from slavery to freedom. It was learning to read, write and become an educated man. He trusted this truth. To quote Emerson, â€Å"To believe your own thought, to believe that what is true for you in your private heart is true for all men,-that is genius† (Emerson 1334). In having this truth revealed to him he also later instructed other slaves how to read and write. He knew it wasn’t going to be easy from this point on to learn but he did any way he could. He learned from boys on the streets of Baltimore and from his master’s child’s school books. Trusting himself on this new information was the key piece to freedom which firmly planted him on his path to escaping slavery. To speak of non-conformity as another one of the elements of Emerson’s, Self-Reliance, that leads to the path of self is to scream to the conformity of slavery. To quote Emerson, â€Å"What I McTeigue 4 must do is all that concerns me, not what people think. The rule, equally arduous in actual and intellectual life, may serve for the whole distinction between greatness and meanness† (Emerson 1337). But to non-conform as a slave was to beaten regularly by the overseer or master and if that didn’t work the slave was sold and sent away. In one extreme case Douglass tells the story of an overseer shooting a slave in the face in front of other slaves because the slave didn’t get out of a creek when told to by the overseer. When asked by the owner of the plantation why he shot the slave, Douglass recalls the justification, â€Å"He was setting a dangerous example to the other slaves,-one which, if suffered to pass without some such demonstration on his part, would finally lead to the total subversion of all rule and order upon the plantation† (Douglass 1758). With these experiences and stories slaves were kept down from entertaining thoughts of freedom or individuality. They conformed not only because it was a way of life; it was survival. Non-conformity came at a price even death as just revealed but for a few the risk was worth the price for possible freedom even if it was only one step toward intellectual freedom from a master. In a pivotal event toward breaking away from the mindset of slavery Douglass rises up against one of his master’s, Mr. Covey and engages in a physical brawl. Mr Covey was going to tie up Douglass and begin another round of beatings following the first round from the previous day. Not only did Douglass physically beat up Covey, he also told him that yes he was going to continue the fight because he had been abusing him for the past six months. Douglass explains in his narrative that this event gave him confidence and the determination to be free. He states, â€Å"My long-crushed spirit rose, cowardice departed . . . and I now resolved that, however long I might remain a slave in form, the day had passed forever when I could be a slave in fact† (Douglass 1779). Douglass crossed the line that day from conformity to non-conformity. McTeigue 5 Douglass’s actions in the above example and the way he progresses through his life’s journey embodies this profound paragraph of Emerson’s whereby he explains that â€Å"conforming to the usages that have become dead to you . . . scatters your force. It loses your time and blurs the impression of your character† (Emerson 1337). He goes on to say that by conforming so much of your life force is taken away from your real purpose that no one can detect who you really are. â€Å"Do your work, and you shall reinforce yourself† (Emerson 1337). Douglass hits the path of non-conformity and never looks back. His life was spent hard at work for the abolitionist movement and the well being of other slaves still trapped in slavery. Intuition is layered into both elements of Emerson’s thoughts of trusting one’s self and non-conformity; as intuition is the soul force that leads us into and out of the sublities of our mind and eventually to our own individual actions. Emerson says about intuition, â€Å"In that deep force, the last fact behind which analysis cannot go, all things find their common origin. . . Here is the fountain of action and of thought† (Emerson 1341). Intuition is not learned or taught it is there in all people. It can be cultivated and tended to by the individual if they stop to listen, to hear and to trust even it means going against the grain of popular thought or what someone else might think is right for that individual. As stated earlier in the essay Douglass all along seems to be â€Å"listening† and â€Å"trusting† and â€Å"taking action.† But he starts to develop a cognizant understanding of intuition and the soul as he becomes more literate and knowledgeable. In an anthology he reads different passages that as Douglass states, â€Å"They gave tongue to interesting thoughts of my own soul, which had frequently flashed through my mind, and died away for want of utterance. . . The reading of these documents enabled me to utter my thoughts† (Douglass 1765). Aside from taking actions towards his freedom and being an McTeigue 6 individual man he now is able to articulate and write down his personal thoughts formulating arguments against slavery and other subjects. A flow from his intuition, mind and soul begins to emerge that was there all along. Douglass explains at the risk of being called superstitious, â€Å"From my earliest recollection, I date the entertainment of a deep conviction that slavery would not always be able to hold me within it’s foul embrace; and in the darkest hours of my career in slavery, this living word of faith and spirit of hope departed not from me, but remained like ministering angels to cheer me through the gloom† (Douglass 1761). Like divine interventions Douglass pays attention to these unsolicited angles and lets them lead the way towards becoming a free man. These two extraordinary men grabbled with the ideas of individuality and self-reliance simultaneously through two different modes of exploration; Emerson intellectually and Douglass experientially. It’s like Douglass’s narrative is the case study for Emerson’s theories on selfreliance. Their studies and paths eventually led them to similar conclusions on the subject; although Emerson’s self-reliance had a more â€Å"soulful† twist and Douglass’s self-reliance had a more practical hands-ons twist. These differences stemmed from their different backgrounds and experiences. Both these men listened to their intuition, trusted them selves and were not afraid to be non-conforming and became self-realized free men. But in the case of Frederick Douglass not only did he became intellectually free but physically free from slavery using all the same tools spelled out in Emerson’s, Self-Reliance. To end, Douglass shares an exchange with one of his masters, â€Å"He told me, if I would be happy, I must lay out no plans for the future. He said, if I behaved myself properly, he would take care of me. Indeed, he advised me to complete thoughtlessness of the future, and taught me to depend solely up him for happiness. He seemed McTeigue 7 to see fully the pressing necessity of setting aside my intellectual nature, in order to contentment in slavery† (Douglass 1792). Case Study About Frauds in Information System Essay

1. Compose a summary of the case. Include how the fraud was perpetrated, the characteristics of the perpetrator(s) who committed the fraud, the role the auditor(s) had in the case, and the direct and indirect effects the incident had on the organization’s stakeholders (customers, vendors, employees, executive committee, and board of directors). Comerica is being sued by Experi- Metal’s for a $560,000 phishing attack to their bank account. Experi- Metal, a custom auto- parts maker, was hit by phishing criminals in January 2009. The fraud was perpetrated when the bank’s vice president received a phishing email telling him to fill out online paperwork to perform scheduled maintenance. The e-mail appeared to have been sent from the bank. The email was sent from phishing criminals) Once the president sent over his credentials the attack was started. Experi- Metal accused Comerica of failing to take immediate action that could have eliminated some of the loss. The bank processed over a million dollars in wires from the companies account. The attack was done in a matter of hours. Criminals tried to move millions of dollars to an Eastern Europe account. Comerica learned of the attack within four hours of the fraud. J.P. Morgan Chase contacted Comerica to report suspicious activity in the account. The criminals were funding money into the Chase Accounts to move it overseas to Russia and Estonia. Comerica shut down the scam but it was after the business lost money. Comerica shut down the account but still processed 15 wires after finding out about the scam. Comerica filed suit against the bank for the phishing attack and to try to recoup some of the money that was paid out through the phishing attack. The characteristics of the perpetrator are usually people from abroad and the emails have spelling errors. The attacks come from abroad and the emails will contain misspelled and transposed letters. The attackers send out thousands of emails trying to get an individual to respond. The emails are intended to trick users into clicking on the link and entering their personal information. The email will impersonate a company such as a bank. The email will state there is a problem and need the individual to verify their information. It will include a cause of action prompting the user to respond or delete. The direct and indirect effects on the organization’s stakeholders were the bottom line would be understated because of the lost of money. â€Å"Phishing scams deceive you into revealing your personal, banking, or financial information through links in email that refer your browser to a look- alike fake website that requests your personal, banking and/ or financial†.(Roddel, 2008, pg. 93) The board of directors would need to put something in place with the bank to make sure this doesn’t happen again. This is a lack of internal controls because the vice president should have verified the email before providing his credentials. The direct impact is to cripple the company and its availability of funds, breach confidentiality, and safety. Phishing has a negative impact on a company’s revenue which is a direct impact on the stakeholders. The direct effect could include legal fees, and additional marketing expense to recapture lost revenues. An organization should communicate with its stakeholders when a phishing attack happens to eliminate the stakeholders losing confidence in the organization. An indirect effect to stakeholders is responding to media inquiries, and delivering messages to parties affected. 2. Suggest the fraud classification(s) the case can be categorized into (based on the data processing model). Include your rationale for the classification. â€Å"By far the most common form of corporate identity theft used by fraudsters is ‘phishing’. Phishing involves fraudsters sending e-mails under the guise of a bank or other reputable company, which appear authentic, to customers or users of that particular company. The emails invite them to log on to the company’s website and verify their account details, including their personal identification details† (Simmons & Simmons, 2003, pg. 8). The controller of Experi-Metal’s received an email that appeared to be urgent. The email stated the bank needed to carry out scheduled maintenance on its banking software. It instructed the controller to log in to the website via the link in the email. The email appeared to come from Comerica’s online banking site. The site asked the controller to enter a security code. The website was fraudulent and was used to get the information to process the fraudulent wires. 3. Suggest the type of controls that may have been in place at the time of the violation. The goal of any organization is to prevent or limit the impact of phishing attacks. The company probably had an in house phishing plan in place. Corporate organizations have policies and procedures to help deter phishing attacks. This should have included training of employees to avoid a phishing attack. The controls in place at Experi-Metal probably included a preventive plan that consisted of employee training and e-mail filters. There needs to be more effective controls in place to prevent this from happening in the future. The controller should never have given his personal information out online without verifying through the bank. Management has to be made aware of the types of phishing attacks through education and an effective policy needs to be in place to cover these types of attacks. The system did not fail it was the actions of the controller which led to the phishing attack. 4. Recommend two (2) types of controls that could be implemented to prevent fraud in the future and additional steps management can take to mitigate losses. â€Å"Avoid emailing personal and financial information. If you get an unexpected email from a company or government agency asking for your personal information, contact the company or agency cited in the email, using a telephone number you know to be genuine, or start a new Internet session and type in the Web address that you know is correct† (McMillian, 2006, pg. 160). A variety of efforts aim to deter phishing through law enforcement, and automated detection. One thing that should be stressed at Experi- Metal is never follow links in an email claiming to be from a bank. Bank institutions never ask you to verify your online banking username and password. The controller should have contacted the bank and verified the information before he entered the code. The motto is trust no email or web site. The business should have in place controls to keep this from happening going forward. Second, Experi- Metal should install a good Anti-virus and firewall protection software and adjust the settings to tighten up web security. Any customer or business that has an excessive amount of wires the bank should place a stop on the account and it needs to be verified before anymore wires are processed. Experi-Metal could have positive pay on the account and this would eliminate any wires from being processed without their approval. Additional employee training should be offered to help employee’s be able to notice fraudulent emails. An individual should never respond to any emails asking for personal information. The bank should follow policy to protect and inform customers about fraudulent activity. 5. Judge the punishment of the crime (was it appropriate, too lenient, or too harsh) and whether the punishment would serve as a deterrent to similar acts in the future. The court ruled in favor of Experi- Metal in the case. Comerica was held liable for over half a million dollars stolen from Experi-Metal. The punishment was not hard because Comerica failed to act in good faith when it processed over 100 wire transfers in a few hours. The bank should have stopped the wire transfers and contacted the company. A customer is holding a bank responsible to keep their money safe. Most of the money was recovered but the judge ruled in favor of Experi-Metal based on the fact the bank did not respond quick enough in stopping the wire transfers. Banks are doing a better job at spotting fraud because of this case but there is still room for improvement. This was a major case because it put pressure on banks to strengthen their security posture. The judge is holding the banks responsible to the safe keeping of a company’s money.
